- As an American citizen, the defendant is to be released into the custody of her lawyer, Jeryn Hogarth of the firm Hogarth Chao & Beowitz.

I write in response to an Order Issues by the Clerk’s Office on January 27th 2017, in the above captioned appeal, directing this office to “file a responsive brief on behalf of the Chief Judge of the Northern District of New York” by February 13th, 2017.
It is not clear to this Office that it has the authority to file a brief in this appeal. We have made an inquiry to the Department of Justice and are awaiting guidance. You should note, however, that neither the United States nor any federal agency or employee is a party to the appeal. While on the January 27th Appeal directs this office to file a brief on behalf of the United States District Judge Gary L. Sharpe, he is not party to the appeal in either this capacity or as a private citizen.
